交警在公路巡逻时,发现一面包车有违章情节,遂指令其靠边停车。不想在不远处,一辆三轮摩托车和一辆自卸货车突然发生碰撞,导致三轮车驾驶员死亡。死者家属在获得保险公司和肇事者的赔偿之后,又以交警违法查车“株连”交通事故为由,将公安局告上了法庭,由此引发了一场特殊的行政诉讼。交警查车是否存在违法行为?其行为与本起事故有无关联?2010年10月底,河南省洛阳市中级人民法院向外界公布了这起案件的终审结果。
