《中华人民共和国刑事诉讼法》第一百一十五条、《人民检察院刑诉规则(试行)》第五百七十五条,赋予了检察机关控告申诉部门办理对本院办案违法行为的控告申诉职责。自该项新增业务开展以来,检察机关面临着对本院办案违法行为的理解与适用问题,本文分析了实践中办理此类案件中存在的问题,并积极探索了应对方法。 Article 115 of the Criminal Procedure Law of the People’s Republic of China and Article 555 of the Criminal Procedure Rules of the People’s Procuratorate (for Trial Implementation) have given the procuratorial organs a complaint against the appealing department for handling the accusation of illegal activities in our hospital Complaint responsibility. Since the commencement of this new business, procuratorial organs have been faced with the problem of understanding and applying illegal activities in our courts. This article analyzes the problems in handling such cases in practice and explores the coping methods.
