2004年12月,中国消费者协会(以下简称中消协)对我国保险业涉及寿险和车险的十大不平等格式条款作了点评(媒体俗称十大“霸王条款”),引起社会广泛关注。细读中消协推出的十大保险“霸王条款”,发现只有少数条款属于真正意义上的“霸王条款”;绝大多数条款并不是“霸王条款”;有些“霸王条款”属于不公正理赔行为,也即属于保险理赔文化范畴。另一有趣的现象是,在中消协点评以后,各家保险公司并没有采取多少有效行为以去霸王化,保险条款仍然是霸王依旧,甚至于在2005年
