法治现代化和法治精神之间是相互依赖的,并且存在着互动性,法治现代化的实现需要将法治精神作为必须具备的要素,法治社会的成熟性需要有法治精神,并且有法治精神的反映制度。如果缺少法治精神,即使制度再怎么完善也不能实现法治社会。本文认为要实现法治现代化,需要涉及法治精神、法治社会和谐社会等环节,和谐社会是法治现代化过程中的理想境界,需要将法治精神作为基础和前提。
The modernization of the rule of law and the spirit of the rule of law are interdependent and interactive. The realization of the rule of law modernization needs to take the spirit of the rule of law as an essential element. The maturity of the rule of law society requires the rule of law and the rule of law reflection. Without the spirit of the rule of law, the rule of law society can not be achieved even if the system is no longer perfect. This article argues that in order to realize the modernization of the rule of law, we need to be involved in the spirit of the rule of law and a harmonious society ruled by law. The harmonious society is the ideal stage in the modernization of the rule of law and needs the spirit of the rule of law as the basis and premise.
