Introduction When the Congress enacted the Administrative Procedure Act (APA) in 1946, it distinguished between different types of rules in the executive branch. The most important is the distinction between legislative and interpretive rules. In most cases, an administrative body can enact legislative rules only through the use of the notice comment procedure prescribed in article 553 of the Administrative Procedure Law. On the contrary, the executive authorities can issue interpretative rules at any time without going through the notice comment process. For over fifty years, courts and commentators have worked hard to establish and apply appropriate criteria for distinguishing between legislative and interpretative rules.
