法治的目的是要限制国家权力,而为了限制国家权力又需要国家权力,这就形成了法治悖论。法治悖论的解决不能依靠国家权力间的相互制衡,而必须依靠向市场和社会分权,用经济权力和社会权力来制衡国家权力。
The purpose of the rule of law is to limit the state power, and in order to limit the state power and the need for state power, which formed the paradox of the rule of law. The solution to the paradox of the rule of law can not rely on the mutual checks and balances of state power, but must rely on the separation of power from the market and society and the balancing of state power with economic power and social power.
