根据我国民事诉讼法规定,要启动查封、扣押、冻结等执行措施,需要法院作出裁定。在研究论证审判权和执行权如何分离时,对于法院作出这些裁定的权力属性,业界存有不同的认识,有人认为是司法裁判权,有人认为是司法行政性质的执行命令权。本文认为,我国民事诉讼法上启动执行措施的裁定权相当于英国执行方法的启动权,在权力属性上属于法官的司法裁判权,但该权力可在一定限度内授权行使。本文建议对民事诉讼法的相关条款作相应修改,建立在法院(法官)控制下授权司法行政性质的执行机构或执行员启动并实施动产扣押、动产的强制交付,以及强制迁出房屋或退出土地等执行措施的制度,通过法院授权形式构建审判权和执行权相分离的体制。
According to the provisions of the Civil Procedure Law of our country, it is necessary for the court to make a ruling if it wants to start the implementation measures of seizure, seizure and freezing. When studying and demonstrating how judicial and executive powers are separated, the industry has different understandings about the power attributes that the courts make in these rulings. Some people think that it is the power of judicial jurisdiction and some consider it an executive order of judicial and administrative nature. This paper argues that the ruling right of starting enforcement measures in China’s civil procedure law is equivalent to the starting right of the enforcement method in the United Kingdom and belongs to the judicial jurisdiction of the judge on the attribute of power. However, the power can be authorized to exercise within a certain limit. This article suggests that the relevant provisions of the Code of Civil Procedure be amended accordingly to establish enforcement agencies or executives authorized to administer judicial nature under the control of the courts (judges) to initiate and enforce the seizure of movable property, the mandatory delivery of movable property and the forced eviction from or demobilization of land Such as the system of implementing measures, through the form of court authorization to build the separation of judicial power and executive power of the system.
