When crime and infringement coexist, the first thing that needs to be protected is the interests of the state or the public or the private interests of the victims. There are contradictions in the current criminal incidental civil action system . This article starts from the victim’s civil procedural rights and state aid in criminal proceedings, analyzes the existing problems in the protection of victims’ rights, and discusses the solutions to these problems.
