第一条为了妥善解决土地权属纠纷,维护社会主义土地公有制,保护土地所有者和使用者的合法权益,巩固和发展安定团结的政治局面,根据《中华人民共和国土地管理法》和《云南省土地管理实施办法(试行)》的有关规定,结合我省实际,特制定本规定。第二条处理土地权属纠纷,应本着尊重历史,照顾现实,有利于团结,有利于生产生活和建设的原则,互谅互让,充分协商解决。第三条一九六二年九月二十七日《农村人民公社工作条例修正草案》(以下简称《修正草案》)公布前,全民所有制和城市集体所有制单位已经使用(借用的国有土地除外)的土地,其所有权属国家,使用权归使用单位。
