作为批判法学运动领军人物的邓肯·肯尼迪,对法学院体制、法学院的教学内容和方法以及法学教育与政治的关系等问题进行了长期不懈的研究,对美国的法学教育有着独到的研究和见解。虽然其观点有着鲜明的左翼色彩,也存在或激进或偏颇的成分,但在国内借鉴域外法学教育制度的大潮中,从另一侧面反思域外法学教育可能存在的问题,尤其是借助批判法学的马克思主义研究方法与资源来思考我国的法学教育,或许能够有助于其在国际化背景中良性发展。
Duncan Kennedy, the leader of the critical juridical movement, conducted a long-term and untiring research on the law school system, the teaching contents and methods of the law school, and the relationship between law education and politics and has unique research and opinions on the legal education in the United States . Although its viewpoint has a distinctive left-wing color and its radical or biased components, in the tide of drawing lessons from the jurisprudence of extra-territorial legal education domestically, it may reflect on the possible problems existing in extra-territorial legal education from the other side, especially with Marxism in critical jurisprudence Doctrine, research methods and resources to think about China’s legal education, may be able to help its healthy development in an international context.
