消费者反悔权制度是一项倾斜性的法律制度,其主要目的是保护消费者的权益。通过赋予消费者在签订合同之后的一段时期内,无须说明理由,且不必承担任何责任,即可撤回合同的权利,从而使双方订立的合同恢复到初始状态。消费者反悔权制度真正体现了倾斜保护、利益平衡的立法精神,提高了消费者权益的保护水平,体现了公平、自愿的民法精神。它顺应了保护消费者权益的国际趋势,是市场经济发展的必然选择。2013年10月25日全国人大常委会表决通过了新的《消费者权益保护法》,新法首次赋予消费者反悔权,消费者反悔权制度符合市场经济发展的要求,符合现今的消费模式。虽然新法中增加了反悔权的规定,但是其规定过于笼统和简单,可操作性较弱,不能够满足我国消费者权益保护的实际需求。文章通过对反悔权的研究,联系当前的中国国情,分析我国消费者反悔权的不足,并就反悔权的具体制度设计提出完善建议。 The system of consumer regret is a lean legal system whose main purpose is to protect the rights and interests of consumers. By giving consumers the right to withdraw the contract for a period after signing the contract without any justification and without any liability, the contracts concluded by both parties are restored to their original status. The system of consumer regret truly reflects the legislative spirit of favoring the protection of interests and balancing interests, raising the level of protection for consumers’ rights and interests and embodying the fair and voluntary spirit of civil law. It conforms to the international trend of protecting consumers’ rights and interests and is the inevitable choice for the development of market economy. On October 25, 2013, the NPC Standing Committee voted to adopt a new Law on the Protection of the Rights and Interests of Consumers. The new law gives the consumer the right of regain for the first time. The system of consumer regret is in line with the requirements of the market economy and is in line with the current consumption pattern. Although the new law has added the repentance, its provisions are too general and simple, and the operability is weak, which can not meet the actual needs of the protection of the rights and interests of consumers in China. Through the study of the right of regret, the article, in connection with the current situation in China, analyzes the shortcomings of our country’s consumer right of regret and puts forward some suggestions on how to design the system of regretting power.
