第一条发布食品广告,应当遵守《中华人民共和国广告法》(以下简称《广告法》)、《中华人民共和国食品卫生法》(以下简称《食品卫生法》)等国家有关广告监督管理和食品卫生管理的法律、法规。第二条本规定所指食品广告,包括普通食品广告、保健食品广告、新资源食品广告和特殊营养食品广告。保健食品是指具有特定保健功能,适宜于特定人群,具有调节机体功能,不以治疗疾病为目的的食品。新资源食品是指以在我国新研制、新发现、新引进的无食用习惯或者仅在个别地区有食用习惯的,符合食品基本要求的物品生产的食品。
The first publication of food advertisements shall comply with the relevant provisions of the People’s Republic of China on Advertising Supervision and Administration and Foodstuffs (hereinafter referred to as “Advertising Law”), “Food Sanitation Law of the People’s Republic of China” (hereinafter referred to as “Food Sanitation Law”), Health management laws and regulations. Article 2 The advertisement of foodstuffs covered by these Provisions includes ordinary food advertisements, health food advertisements, new resources food advertisements and special nutritious food advertisements. The new resources of food refers to the newly developed in China, newly discovered, newly introduced non-eating habits or only in some areas have eating habits, in line with the basic requirements of food products produced food.
