本文认为,现代法律的原则主要有:现代法在实际运用中由统一的、不变的原则组成,是一种和解的法律,现代法规具有普遍性。这种制度是等级式的,以官僚政治的形式创立,是理性的,由专业人员制定。由于该制度变得更加专业化和复杂化,在法庭和必须处理法庭事务的人之中出现了专门的职业中介,该制度是可以修改的,制度是政治性的,判决法的任务以及运用到具体的案例中不同于其它政府职能在人事和技术方面的任务。法制现代化就是上述法律特征的发展过程,或是朝着这些特征持续变化的过程,这一现代化进程仍在西方国家进行着。现代化法律模式强调它的统一性、一致性和普遍性,但事实上没有一种法制是真正统一的、有规律的、普遍的。每一种法律在寻求统一性的时候都面临着适应地区性准则并对地区性问题做出解释的问题。涉及到广泛领域的法制是多级的,它必须有众多的、较小的地方机构将这一法律运用到许多地方的日常事务中。法律的规范相对于官员和非专业人员及法律职业人员自己采用的现行惯用法之间不可避免地会有矛盾,因而法制现代化又具有丰富性和多样性。因此,作者认为每一个社会必须在统一性和多样性之间寻找到一种合适的平衡。
This article argues that the principles of modern law are mainly as follows: modern law consists of a unified and unchanging principle in its practical application, and is a law of reconciliation. Modern laws and regulations are universal. Such a system is hierarchical and created in the form of bureaucratic politics. It is rational and formulated by professionals. As the system becomes more specialized and complex, specialized occupational agents appear in the courts and those who must deal with the affairs of the courts, the system is modifiable, the system is political, the task of the judiciary and its application The specific case is different from the personnel and technical tasks of other government functions. The modernization of the legal system is a process of development of these legal characteristics or a process of continuous changes in these characteristics. This process of modernization is still under way in Western countries. The modern legal model emphasizes its unity, consistency and universality. However, in fact, none of the legal systems is truly unified, regular and universal. Each law faces the problem of adapting to regional norms and explaining regional issues when seeking unity. There are many legal systems covering a wide range of areas. It must have a large number of smaller local institutions that apply this law to the daily affairs of many places. There are inevitably contradictions between the norm of law and the current prevailing law adopted by officials and non-professionals and legal professionals themselves. Therefore, the modernization of law system is also rich and diverse. Therefore, the author believes that every society must find a suitable balance between unity and diversity.
