案情简介申请人于2008年1月1日与某劳务派遣公司签订为期两年的劳动合同,约定派遣申请人至某电子有限公司任财务管理,月工资5150元。劳动合同中同时约定:“本合同期满双方无异议的,本合同自动顺延一年;顺延期满时双方无异议的,本合同期限再自动顺延一年,并以此类推。”2009年2月8日,申请人生育,并休产假至当年6月11日。2010年2月1日,该劳务派遣公司和电子公司书面告知申请人劳动合同将于2月7日到期终止,当日,申请人离职。申请人现称2009年12月31日前单位未通知其到期终止劳
Brief introduction of the case The claimant signed a two-year labor contract with a labor dispatch company on January 1, 2008, and agreed to send the claimant to an electronic limited company for financial management with monthly salary of RMB5,150. The contract of labor also stipulates at the same time: “The two sides of this contract have no objection at the expiration of this contract, the contract is automatically extended for one year; when the two sides have no objection after the extension, the term of the contract is automatically extended by one year and so on.” On February 8, 2008, the applicant gave birth and took maternity leave until June 11 of the same year. On February 1, 2010, the labor dispatch company and the electronic company informed the applicant in writing that the labor contract will expire on February 7, the same day the applicant resigned. The claimant now states that the unit did not notify its termination of labor due on December 31, 2009
