法律赋予大学生申诉权的制度设计目标就是为了保障学生权利,防止学校滥用权力,实现校园法治。然而在现实中,学生申诉制度在一定程度上失落了其应当彰显的功能,呈现出“权利救济虚置”和“权力监督困境”的问题。要实现学生申诉制度功能的理性复归,制度的修正与完善是根本的路径选择。我们认为,需要对学生申诉制度的修正与完善 The system design goal that the law gives college students right to appeal is to protect students’ rights, prevent schools from abusing their power and realize the rule of law on campus. However, in reality, the student appeal system has lost its function which should be manifested to a certain extent, presenting the problem of “right relief ” and “power monitoring dilemma ”. In order to realize the rational return of students’ appealing system function, the revision and perfection of the system are the fundamental path choices. We think it is necessary to amend and improve the student appeal system
