撤案程度亟待完善晏向华我国刑事诉讼法对司法机关的诉讼行为大都规定了相应的制约监督程序，比较充分地保证了办案质量。但是对侦查阶段的一些行为却规定得不那么完善。如对侦查阶段撤销案件这一诉讼决定，在制约和法律监督方面就是个空日。刑事诉讼法第九十四条规定：“...
