在反倾销案件中,出口国企业和进口国企业间的价格竞争是进口国企业发起诉讼的主要原因。本文通过对寡头垄断企业间的价格竞争(Bertrand竞争)分析,对反倾销的两种结果:征收反倾销税和中止协议(主要是价格承诺),进行了评估。最后作者提出建议:价格承诺是企业遭受反倾销诉讼时的一个较优策略选择。
In anti-dumping cases, the price competition among exporting and importing countries is the main reason why importing country enterprises initiate litigation. Through the analysis of price competition among oligopolistic enterprises (Bertrand competition), this paper evaluates two kinds of anti-dumping results: anti-dumping duties and suspension agreements (mainly price commitments). Finally, the author put forward the suggestion: price commitment is an excellent strategy choice when enterprises suffer anti-dumping litigation.
