现代经济飞速发展,各种专利发明、实用新型日新月异,网络技术问世,这一切的变化和发展都影射到知识产权使之随着发生相应的改变。由于知识产权的范围太过广泛,所以本文以著作权现代发展为代表,从客体保护种类增加、权利扩张和限制为切入点,通过利益平衡机制这一知识产权最基本的原则来探讨这些变化合理性。
The rapid development of modern economy, various patented inventions, utility models with each passing day, the advent of network technology, all of these changes and developments are reflected in the intellectual property so as to make the appropriate changes. Because of the scope of intellectual property is too wide, this article takes the modern development of copyright as the representative, starting from the increase of the types of object protection, the expansion and restriction of rights as the starting point, through the most basic principle of the balance of interests mechanism to explore the reasonableness of these changes .
