人权保障不仅是设立警察权初衷,也是矫正运行状态的标尺,更是警察权运行终极目的。警察立法环节人权保障缺位、警察职权行使过程中权力属性的异化及警务保障中的缺失,导致人权保障目的的丧失。完善警察立法体系,在警察权运行过程中树立“权利本位”、“程序优位”理念且倡导以人为本的警务战略是校正警察权运行和目的之关键。
Protection of human rights is not only the original intention of setting up a police power, but also a measure of rectifying the state of operation. It is even the ultimate goal of the operation of police power. The absence of human rights protection in the police legislative process, the alienation of the power attributes and the lack of police protection in the exercise of police powers lead to the loss of the purpose of human rights protection. Improving the police legislative system and establishing the concept of “rights based” and “superiority in procedure” during the operation of police power and advocating a people-oriented policing strategy is the key to correcting the operation and purpose of police power.
