政府为了公共利益实施农地利用管制时,会造成农地权利人利益损失,从而导致管制性征收。农地权利人的此等损失需要国家给予合理补偿,我国目前尚没有建立系统性的农地利用管制损失补偿制度,对此问题需要在理论上给予充分重视和深入研究。在发达国家,政府通常以市场化方法对农地管制性征收给予合理补偿。我国应当在借鉴国外成熟立法经验的基础上建立健全针对农地利用管制的补偿制度,尤其是需要强化市场化补偿制度。
When the government implements the regulation of the utilization of farmland for the public interest, it will cause the loss of interests of the right holder of the farmland, resulting in a regulatory charge. Such loss of land rights holders needs the state to provide reasonable compensation. At present, China has not set up a systematic compensation system for the loss of utilization control of land use rights. Therefore, this problem needs to be given sufficient attention and in-depth research in theory. In developed countries, the government usually provides market-based compensation for the controlled acquisition of farmland. China should establish and improve the compensation system for agricultural land use control based on the experience of mature foreign legislation, especially the need to strengthen the market-oriented compensation system.
