国际经济秩序的发展目标与国家立场出现的困惑,应以国际经济法治这一概念予以明确。国际经济法治是法治的理想和手段在国际层面、经济问题上的表现,具体包括国际经济良法和全球经济善治两个方面,要求规范价值设定符合人本主义、可持续发展、和谐共进的社会目标,也要求规范清晰明确、稳定权威。国际经济立法过程需要公开透明、民主高效、科学严谨,同时要有诚实善意的守法、严格有效的执法、公正便捷的司法。国际法治落实的关键在于国家如何行为,不同主体、不同环节有不同的推进方式,但是最主要的主体是国家,核心在于规范的订立和遵守阶段。未来国际经济法治的方向与步调,应当是方向明确,步调稳定,强调渐进。
