从整个比较法学的发展史来看,比较法学对各国的立法都起着非常重大的影响。其中,对由计划经济向市场经济转变的当代中国的立法影响更为深远,中国当代的立法应根植于中国本土的社会背景与文化,吸收各国立法的精华,不断的完善和创新。
From the perspective of the history of comparative law, comparative law plays a very important role in the legislation of all countries. Among them, the influence on the legislation of contemporary China, which is transformed from a planned economy to a market economy, has a far-reaching impact. The contemporary Chinese legislation should be rooted in the social context and culture of China’s native land, absorb the essence of the legislation of all countries, and constantly improve and innovate.
