1993年,中国修改的商标法扩大了商标保护的范围,将服务商标纳入保护之中,此举标志着中国的商标法正式确立了对服务商标的保护制度。但令人遗憾的是,商标法的修改只是将商标的定义延伸到服务商标,然后再表述为“本法关于商品商标的规定,适用于服务商标”的原则规定。由于立法忽视了服务商标不同于商品商标的强烈个性,套用保护商品商标的有关条款来保护服务商标反而无法操作,也给商标的理论和实践带来了诸多困惑。有鉴于此,本文试就有关的法律问题进行探讨,以求对完善我国的商标法稍尽绵薄之力。
In 1993, the Trademark Law amended by China expanded the scope of trademark protection and incorporated service marks into protection. This marks that China's Trademark Law formally established a system of protection of service marks. However, it is regrettable that the amendment to the Trademark Law simply extends the definition of a trademark to a service mark and then states the principle of “the provisions of this Law on trade marks applied to service marks.” Because legislation ignores the strong personality of service marks different from the trademarks of goods, the protection of service marks by applying the relevant provisions of the protection of goods marks can not be operated, but also brings many confusion to the theory and practice of trademarks. In view of this, this article tries to discuss the relevant legal issues in order to improve China's trademark law to make a modest contribution.
