一、农地关系的概念研究农地关系必须首先界定“农地”的涵义。农地,顾名思义,即为农村土地。农村土地有狭义和广义两种理解。狭义的农村土地是指以耕作(畜牧)等农业用途为目的而使用的土地,即农用土地,简称农地。而广义的农村土地还包括以房屋(宅基地、乡镇企业建设用地)为目的而使用的土地,这部分土地现行法律称之为建设用地。我们所说的农地即为狭义上的农村土地。农地关系即是指依据有关农地法律规范产生的围绕农地的权属、利用、流转等发生的主体间的权利义务关系形成表现出来的法律
First, the concept of the relationship between farm land Research on the relationship between farm land must first define the meaning of “farmland ”. Agricultural land, as the name suggests, is rural land. Rural land has two kinds of narrow and broad understanding. Narrow rural land refers to land used for agricultural purposes such as farming (livestock husbandry), that is, agricultural land, or farmland for short. The generalized rural land also includes land used for the purpose of building houses (house sites, township and village enterprises) and the current law of this part of land is called construction land. The agricultural land we are talking about is the rural land in a narrow sense. The relation between farm land and land refers to the law that is formed according to the rights and obligations around the ownership, use and circulation of agricultural land, which is generated by the relevant laws and regulations of farmland
