演修改后刑诉法将“未成年人刑事案件诉讼程序”作为“特别程序”予以规定。在“教育为主、惩罚为辅原则”下增加了“附条件不起诉制度”与“犯罪记录封存制度”等对未成年人予以特别保护的制度,并借助于程序功能体现对未成年人犯罪的非犯罪化、非刑罚化、非监禁化处理。由于实体规定与程序要求未能有机衔接和普通程序与特别程序在适用上的界分不明,在认识与实施未成年人刑事诉讼程序中特别需要更新观念和不断完善相关制度。
