中国的农村绝大程度上仍是乡土社会,体现着乡土社会的特点,乡民们处理纠纷时更多的是考虑传统的民俗习惯,注重个案,要求实质正义。处于乡土社会背景中的基层人民法庭如何在依法办案的同时,兼顾乡土社会的特点,考虑乡民的特殊要求,做到纠纷的真正解决,成为我们所关注的焦点。本文从变迁中的乡土社会入手,探讨了人民法庭在依法办案的同时所遇到的现代司法理念与乡土社会特殊要求的冲突,并在此基础上提出了规范基层法庭司法行为的几点建议。
China’s rural areas are still largely native society, reflecting the characteristics of native society. When villagers deal with disputes, they think more about traditional folk customs, focusing on individual cases and demanding substantive justice. In the context of native society, how grassroots people’s tribunals handle the case according to law at the same time, taking into account the characteristics of native society, consider the special requirements of the villagers, so that the real solution to disputes, become our focus. This article starts with the changing native society and discusses the conflicts between the modern judicial concept and the special requirements of native society encountered by the people’s court when handling the case according to law. On this basis, some suggestions are put forward to regulate the judicial behavior of the grass-roots court.
