《无需法律的秩序——邻人如何解决纠纷》是美国耶鲁大学罗伯特.c.埃里克森教授上个世纪90年代初的一部著作,埃里克森教授对加州夏斯塔县牧民如何解决纠纷进行了实地调查,并以此为根据提出了一个有关福利最大化规范的假说,构建了一套完整的非正式规范。该书用法律经济学、社会学以及博弈论的方法分析了社会控制的机制,创新性十足。但是由于书中充满了对法律的压制,其又存在一定的不足。以法律作为社会控制的核心,并没有否认非正式规范在社会控制中的作用,反而能够使得这两种规范更好地发挥作用。
“No Legal Order - How Neighbors Solve Dispute” is a book by Prof. Robert E. Erickson, Yale University, USA, in the early 90s of the last century. How Professor Erickson has dealt with pastoralists in Shasta County, California Dispute resolution conducted a field survey, and on the basis of which a hypothesis about the maximization of welfare was put forward and a complete set of informal norms was constructed. The book analyzes the mechanism of social control with the methods of law economics, sociology and game theory, and is full of innovation. However, due to the book is full of repression of the law, there are some shortcomings. Taking the law as the core of social control does not deny the role of informal norms in social control, but can make these two norms work better.
