一、引言从2003年以来,我国离婚率已经连续12年呈递增状态。~(1)仅2016年上半年全国依法办理离婚手续的共有168.3万对,比上年增长11%。~(2)离婚现象越来越普遍。我国《婚姻法》明文规定“实行婚姻自由、一夫一妻、男女平等的婚姻制度。”婚姻自由是法律赋予自然人的权利,不仅包含了结婚自由也包含了离婚自由。
I. Introduction Since 2003, the divorce rate in our country has been increasing for 12 consecutive years. ~ (1) In the first half of 2016, there were a total of 1,683,000 pairs of divorces completed in accordance with law in the country, an increase of 11% over the previous year. ~ (2) Divorce is more and more common. China’s “Marriage Law” explicitly stipulates that “the implementation of a marriage, monogamy, equality between men and women marriage system.” Marriage freedom is the law granted to natural rights, not only includes the freedom of marriage also includes the freedom of divorce.
