案例:1993年5月,王某与某企业签订了为期五年的劳动合同。1998年5月劳动合同到期,王某要求与企业续签合同,企业未作答复,但也未终止与王某的劳动关系,王某继续在原岗位工作。1999年5月,企业却以劳动合同已到期为由,解除了与王某的劳动关系。王某不服,向劳动争议仲裁委员会提出申诉。仲裁委员会受理了此案,经调解无效,依法作出裁决:企业恢复王某原工作并与其续签不少于一年的劳动合同,补发王某申诉期间应得的工资收入和赔偿费共计500元。
Case: May 1993, Wang and a business signed a five-year labor contract. May 1998 labor contract expires, Wang requested renewal of the contract with the enterprise, the company did not reply, but did not terminate the labor relationship with Wang, Wang continued to work in the original post. In May 1999, the enterprise terminated the labor relationship with Wang with the expiry of the labor contract. Wang refused to submit a complaint to the Labor Dispute Arbitration Commission. Arbitration Commission accepted the case, the mediation is invalid, according to the law to make a ruling: Wang restored the original work and renewal of the labor contract for not less than one year, reimbursement of Wang’s salary and compensation should be earned during the total 500 yuan .
