国际法与国内法的关系问题对致力于宪政改革的非洲国家来说,具有重要的意义。在理论上,国际法与国内法存在着分歧。在实践中,各国通常采用采纳或转化方式使国际法在国内法院中得以适用,并主要借鉴了英国和法国的做法。一些非洲国家不但在宪法中规定了国际法在国内法中的地位,而且规定国内法院在对宪法或其他法律进行解释时,要利用或考虑到国际法。也有许多非洲国家不愿将国际法直接纳入到它们的宪法中。不过,即使在宪法中没有规定国际法地位的非洲国家,它们的法院在审理案件时也常会参照有关国际法的规定。
The question of the relationship between international law and domestic law is of great significance to African countries that are committed to constitutional reforms. In theory, there are differences between international law and domestic law. In practice, countries generally adopt international law in the form of adoption or conversion to apply it in domestic courts and mainly draw lessons from the practices of Britain and France. Some African countries not only stipulate the status of international law in domestic law in the Constitution, but also stipulate that domestic courts should use or take into account international law when interpreting the constitution or other laws. Many African countries are also reluctant to include international law directly in their constitutions. However, even in African countries that do not have the status of international law in their constitutions, their courts often make reference to the provisions of relevant international law when trying cases.
