保障劳工权益是构建和谐社会的一个重要内容。当前,劳工权益遭受侵害问题比较突出,本文在比较了SA8000 和我国劳动法的相关规定后认为,劳工合法权益受损的原因主要不在于制度供给不足,而在于法律、政策没有得到有效实施。为此,需要打造责任政府,建立劳动执法部门的目标责任,加强法律执行的监督机制,以建立一种长效机制使保障劳工权益的法律、政策和措施切实落到实处。
Safeguarding the rights and interests of workers is an important part of building a harmonious society. At present, the issue of the violation of labor rights and interests is quite prominent. After comparing the SA8000 with the relevant provisions of our labor law, this article argues that the reason for the impairment of the legitimate rights and interests of laborers lies not in the inadequate supply of systems but in the fact that laws and policies have not been effectively implemented. Therefore, it is necessary to build a responsible government, establish the target responsibility of the labor law enforcement department and strengthen the supervision mechanism of law enforcement so as to establish a long-term mechanism to effectively implement the laws, policies and measures to protect labor rights and interests.
