地票交易有利于农地有效利用与城镇化建设需求的互补,是我国农村建设用地流转的重要创新。地票交易是城乡建设用地增减挂钩指标在土地交易所内以出让方式进行的流转,包括土地复垦、下达指标、交易地票、使用地票等环节,其法律性质是农地发展权交易。我国现行法律规范中对地票交易的规定较少,并且存在制度障碍。构建我国地票交易法律制度的重点是地票交易的定价机制及交易规则,并且明确交易过程中的利益归属,健全与之配套的土地复垦制度。
Land-ticket transactions are conducive to the effective use of agricultural land and urban construction needs of the complementary, is an important innovation in rural land for construction purposes. China’s current legal norms on the ticket transactions less the provisions, and there are institutional obstacles. The construction of the legal system of China’s land ticket transaction focuses on the pricing mechanism and trading rules of the land ticket transaction and clarifies the vested interest in the transaction and completes the land reclamation system.
