诱惑侦查是侦查机关在侦查破案中实施的一种谋略,是与犯罪分子斗智斗勇的一种特殊侦查方法,它对于打击那些作案手段、方式特别隐蔽、狡诈,证据收集极为困难的犯罪和无直接被害人、难以查证的犯罪有着重要作用。但诱惑侦查是一柄双刃剑,在合法性鉴定上,第一,要看被告人在被侦查人员引诱之前是否存在犯意。第二,要看被告人的犯罪行为与引诱行为之间是否存在必然的因果关系。第三,要看引诱行为是否遵循了正当程序的其他基本要求。
