美学角度视野下的法律英语翻译是目前翻译学科的新课题。首先,它囊括了哲学、翻译学、对比语言学、文化学和文学等学科的内容,是又一项真正的跨学科研究项目。其次,在理论方面,本研究尝试发展和丰富法律翻译的理论。以往法律翻译的研究大多局限在字、词、句等对比翻译的技术探讨。可是,这些默认的规范构成了控制性框架,束缚了译者再现法律原语文化的能力。从现实意义上看,本研究探索美学语境下法律英语翻译的途径。正是在此意义上,也可以说,法律人是法律艺术的缔造者。从美学的观点观察法律的时候,我们很可能会把一个抽离了一切内容和规定性(Gegebenheit)的“纯粹的法”或法的纯形式作为法美学的对象物来研究。通过美学角度的介入,一方面是对原语法律文本负责,保证原作蕴涵的哲学思想、文化概念以及文学价值都能最大限度地体现在译文中;另一方面,译者又着眼于对现实问题的思考,使得国际交流在法律语言视野下更人文、客观、通畅。
The translation of legal English from the perspective of aesthetics is a new topic in the field of translation. First of all, it encompasses the contents of philosophy, translation studies, comparative linguistics, culture studies and literature. It is yet another truly interdisciplinary research project. Secondly, in theory, this study tries to develop and enrich the theory of legal translation. In the past, the research on legal translation was mostly confined to the technical discussions on contrastive translation of words, words and sentences. However, these default norms constitute the control framework, which limits the translator’s ability to reproduce the legal primitive culture. In practical terms, this study explores the avenues of legal English translation in the aesthetic context. It is in this sense that legal persons can also be said to be the creators of legal art. When we look at the law from an aesthetic point of view, we are likely to study as a pure object the object of legal aesthetics, a pure form of “pure law” or law that has been pulled away from all the contents and the rules (Gegebenheit). Through the intervention of aesthetics, on the one hand, it is responsible for the legal texts of the primitives, ensuring that the philosophical thoughts, cultural concepts and literary values implied in the original works can be fully reflected in the translations. On the other hand, the translators also focus on the practical problems Thinking, making the international exchange more humane, objective and unobstructed under the perspective of legal language.
