当代的国际竞争是高新技术的竞争,而技术标准化对于一国的科技与经济发展有着极其重大的意义。在技术标准化的过程中不可避免地会涉及反垄断问题,其中较为突出的是市场支配地位滥用。实践中,标准化组织的知识产权政策与各国的反垄断法对之形成了二元规制模式。我国应该尽快建立技术标准发展战略,以科学的态度对待技术标准化中的反垄断问题。
Contemporary international competition is high-tech competition, and technical standardization is of great significance to a country's science and technology and economic development. In the process of technical standardization, it will inevitably involve antitrust issues. The most prominent one is the abuse of market dominance. In practice, the standardization organization's intellectual property policy and each country's antitrust law form a dual regulatory model. Our country should set up the development strategy of technical standards as soon as possible and treat the antitrust issues in technical standardization with a scientific attitude.
