2016年1月2日,祝先生在浙江省义乌市某汽车销售公司看中一款国产汽车,于当日付订金3000元。销售公司承诺1月20日交付车辆,并表示交付车时再签购车协议。到了交车的日子,商家告知祝先生2月2日再来提车。可到了第二次约定的提车日,车辆仍未能交付,商家要求祝先生2月22日再来提货。祝先生不同意,要求退还订金。可商家表示,车已订,正在等待到货,不能退订金。无奈之下,祝先生只好再等。
