法律移植是一种加快法治现代化进程的方式。但是如果方法不当,往往起不到应有的效果。本文以我国群体诉讼制度的引进为切入点,分析了其在中国效率低下的原因,并据此对我国在法律移植中应当注意的问题加以探寻。
Law transfer is a way to speed up the process of modernization of law. However, improper methods often fail to achieve the desired results. Based on the introduction of our group litigation system in our country, this article analyzes the reasons for its inefficiency in China and explores the issues that should be paid attention to in our country’s transplantation of laws.
