中国的彩票业随着20年前河北省第一张彩票的卖出而标志着中国彩票业的起航,风风雨雨20载各种彩票案震惊国人。本案①发生在2006年,经两审终审。最终判决浙江省体育彩票管理中心赔偿黄建军损失50000元,驳回黄建军其他诉讼请求。本案值得探讨的法律问题集中在,彩票买卖合同的性质是什么?以及彩票买卖合同何时成立?买卖彩票行为中存在的主体分别是什么关系的问题。借助于本案,浅谈本人对彩票买卖合同的认识,以及对彩票立法的期待。
China’s lottery industry marks the beginning of the Chinese lottery industry with the sale of the first lottery in Hebei Province 20 years ago. The case occurred in 2006, the second instance final. Zhejiang Sports Lottery Management Center finally awarded a compensation of 50,000 yuan lost Huang Jianjun, rejected Huang Jianjun other claims. The legal issues worth discussing in this case are focused on the nature of the lottery sales contract and the question of when the lottery sales contract was set up and the subjects that exist in the sale and purchase of lottery tickets, respectively. With the help of this case, I briefly talk about my understanding of the lottery sales contract and the expectation of lottery legislation.
