公用征收是一种常见的行政行为,政府公用征收权运作的失范已经引起了学界的关注,制定统一的公用征收法是行政法治发展的必然要求,从西方公用征收制度的历史发展中探寻当今中国公用征收立法的价值定位具有重要意义。本文力图通过国外公用征收制度的发展找出公用征收制度发展的一般规律,进而结合国情,寻求新时代中国公用征收法的价值定位。
Public expropriation is a common administrative act. The loss of the government’s public expropriation right has aroused the concern of the academic circle. To formulate a unified public expropriation law is an inevitable requirement for the development of the administrative legal system. From the historical development of the public expropriation system in the West, The value orientation of public collection legislation is of great significance. This article tries to find out the general law of the development of public expropriation system through the development of foreign public expropriation system, and then find the value orientation of the Chinese public expropriation law in the new era in light of national conditions.
