高校在制定内部规则时,应当体现和追求秩序、效率与公平的价值取向。但当前高校内部规则存在着设定主体权限划分不明确、规则制定缺乏监督、设定内容存在着不合法性、设定形式不规范、设定程序严重缺失、自由裁量权界限模糊、概括条款和类推原则滥设等方面的合法性缺失现象。高校内部规则完善的现实出路在于:在制定过程中要体现主体、职权、程序的法定,遵循权力制衡原则、法律保留原则;在实施过程中要遵循比例原则、正当程序原则;在司法过程中,应遵循有限司法审查原则。
In formulating internal rules, colleges and universities should embody and pursue the values of order, efficiency and fairness. However, there are some problems in the internal rules of colleges and universities, such as unclear division of authority, lack of supervision on rules, lack of legitimacy in setting contents, non-standard setting forms, serious lack of procedures, ambiguity of discretion, The phenomenon of lack of legitimacy in terms of indiscriminate introduction of analogy. The realistic way to improve the internal rules of colleges and universities lies in: the formulation of the main body, authority, the statutory procedures, follow the principle of checks and balances of power, the principle of legal reservation; in the implementation process should follow the principle of proportionality, due process; in the judicial process, The principle of limited judicial review should be followed.
