我国检察机关在刑事侦查中的回避制度构建具有有因回避及检察人员个人回避的特色。注重隔断办案个人利益关系链,通过排除办案人员个人与案件的利害关联性来保证侦查的中立和客观远远不能契合回避制度的正当性基础“自然公正”原则。对检察机关刑事侦查回避制度进行改良,采有因回避与无因回避、个人回避与整体回避相结合,将一切与案件有利害关系可能影响公正侦查结果实现的因素予以排除。
The evasion system of procuratorial organs in criminal investigation in our country has the characteristics of avoidance and individual evasion by prosecutors. Pay attention to the interception of individual interest chain case handling, by excluding investigators personal and case interests to ensure the neutrality of the investigation and the objective is far from fit the legitimacy of the avoidance system “natural justice ” principle. The procuratorial organs to improve the criminal investigation and avoidance system, adopt a combination of avoidance and no-cause avoidance, personal avoidance and overall avoidance, to exclude all factors that may have an impact on the realization of fair investigation results.
