共同犯罪问题一直是刑法理论界的重点和难点之一。其中一个一个争议较大的问题就是片面共犯,作为一种自古就有的现象,片面共犯问题急需在理论和实践中加以解决。本文本着理论上探讨问题、实践中解决问题的初衷,试提出自己的观点——片面共犯属于共同犯罪的一种行为类型。同时对片面共犯的界定与分类加以论述。
The issue of common crime has always been one of the key and difficult points of the criminal law theoretical community. One of the most controversial issues is the one-sided accomplice. As a phenomenon that has existed since ancient times, the issue of one-sided accomplice is in urgent need of solution in theory and practice. Based on the original intention of problem-solving in theory and problem-solving in practice, this article tries to put forward my point of view - a type of behavior that one-sided accomplice belongs to common crime. At the same time, the definition and classification of unilateral accomplice are discussed.
