严冬系旭日商业集团公司员工。他与公司于2004年签订了10年的劳动合同。2007年7月,严冬患病就医时,医院意见让休息三个月治疗。当时,公司也同意他休假治病,但告知不予支付工资。对此严冬不理解,便找到单位领导论理。单位负责人解释说,企业已经为全体员工缴纳了医疗保险费,因此,就不再承担相关的病假工资了。这种解释,严冬仍无法接受,双方由此发生争议。于是,严冬将所在公司告上劳动争议仲裁委员会。
