随着政府公共管理从线性模式到复杂模式,从稳定运行到动态治理,从政府创新到社会协助,全球都步入到一个以电子媒体为主体的时代。电子政务的蓬勃发展推进了电子智力体系和信息处理能力的现代化演进,并利用先进的科学技术和社交媒体向公众提供着更加有效、便利的公共服务,增加了公众对政府电子化和信息化的依赖。另一方面,电子政务的高信息化又引发了公众对于信息开放以及信息安全的担忧。从爱德华·斯诺登事件中,以美国为首的西方国家利用信息技术和手段窃得的数据和资料已经给涉及国家带来了重大的政治影响和经济损失,也极大地危害了国家的利益与安全。因此,要想在当今世界格局中掌握先机,就必须从国家战略层面、法律层面以及技术层面给予相应的支撑和协助,保护国家安全,维护个人利益。本文在分析了电子政务信息安全法律现状的基础上,对比欧盟和美国等西方国家经验,提出了我国电子政务领域中信息安全的法律问题,并给出了相应的对策和建议。

On the other hand, the high informationization of e-government has also raised public concerns about the openness of information and information security. From the Edward Snowden incident, the data and information stolen by Western countries headed by the United States using information technology and tools have brought major political impact and economic losses to the countries involved, as well as greatly jeopardizing the interests of the state. Safety. Therefore, in order to seize the first-mover advantage in today’s world pattern, we must give corresponding support and assistance from the national strategic, legal and technical levels to safeguarding national security and safeguarding individual interests. Based on the analysis of the status quo of E-government information security law, this paper compares the experience of Western countries such as the European Union and the United States, puts forward the legal issues of information security in the field of E-government, and gives the corresponding countermeasures and suggestions.
