以合法性为逻辑起点,论证中小学章程的实质合法性与形式合法性,旨在明晰中小学章程的法理基础,进一步明确中小学章程关涉主体,确保章程制定的程序规范和文本规范。通过阐释形式合法性的内在含义与实质合法性的外在要求,为进一步制定符合中小学现实情境的章程做出理论分析。
With legitimacy as the logical starting point, this paper proves the substantive legitimacy and formal legitimacy of the constitution of primary and secondary schools. The purpose of this article is to clarify the legal basis of the constitution of primary and secondary schools, further clarify the main body of the articles of association of primary and secondary schools and ensure the procedural norms and textual norms of constitutional formulation. By explaining the inherent meaning of formal legitimacy and the substantive legitimacy of the external requirements, in order to further formulate the constitution of the reality of primary and secondary schools to make a theoretical analysis.
