一 《中华人民共和国行政处罚法》(以下简称《行政处罚法》)已由八届全国人大四次会议于1996年3月17日通过,并自996年10月1日起正式施行。《行政处罚法》的制定和实施,对于规范行政处罚的设定和实施,保障和监督行政机关有效实施行政管理,维护公共利益和社会秩序,保护公民、法人或者其他组织的合法权益,具有十分重要的现实意义。根据《行政处罚法》的有关规定,对于公民、法人或者其他组织违反行政管理秩序的行为,应由国家行政机关依照法定程序予以处罚(第三条)。在进行行政处罚时,应当制作行政处罚决定书(第三十九条)那么,这一文书应当载明哪些事项?其具体的撰制模式怎样?本文就此问题谈点粗浅的看法。
