民营经济是在改革开放的历史条件下发展起来的。民营经济的产生和发展,对于经济体制的改革,特别是国有国营企业管理体制的改革,以公有制为主体的多种经济成份的成长,国民经济的发展,都产生了积极的作用。如何继续推进民营经济的大发展,是人们十分关注的问题。邓小平同志《在武昌、深圳、珠海、上海等地的谈话要点》中说:“还是要靠法制,搞法制靠得住些。”不仅反腐倡廉、打击犯罪活动要靠法制,物质文明和精神文明建设要靠法制,发展民营科技产业也要靠法制。本文就谈谈法制建设与民营经济,特别是建立健全法律体系与发展民办科技产业的关系。
