在航运协议反垄断豁免制度上,欧盟和美国的做法有所不同:欧盟新模式主要是通过将一般竞争法引入航运垄断协议的规制中,取消了班轮公会的反垄断集体豁免权;美国模式则继续保留反垄断豁免制度但配以相应的备案监管制度。鉴于目前我国航运协议反垄断豁免制度立法上的缺失,在将来制定《航运法》时,可以适度参考欧美模式中的有益做法,建构适合我国的航运反垄断协议豁免制度。
In the antitrust exemption system for shipping agreements, the EU and the United States have different approaches: the new EU model removes the antitrust collective immunity of liner conventions mainly by introducing the general competition law into the regulation of shipping monopoly agreements; and the U.S. model Continue to preserve the antitrust immunity system but with the corresponding filing supervision system. In view of the current lack of legislation on antitrust exemption of China’s shipping agreement, we can make some reference to the beneficial practices in the European and American models when formulating the “Shipping Law” in the future and construct an exemption system for our antitrust agreement on shipping.
