随着人体器官移植技术的不断进步和相关立法的不断完善,越来越多的重病患者可以通过移植人体器官得到重生。我国立法规定人体器官的移植要遵循自愿捐赠的原则,可见捐赠是移植的重要前提。然而目前我国的人体器官捐赠工作还有很多不完善的地方,特别是捐赠的具体程序缺乏完善的立法规制,这就导致了捐赠工作不能有序的开展,也影响了供体的数量,进而成为人体器官移植工作的障碍,因此如何完善我国人体器官捐赠的具体程序成为了我们目前要重点解决的问题。
