通过对权利穷竭产生的理论基础的分析,提出利益平衡是权利穷竭原则产生的根源,利益平衡是各国考量平行进口性质的决定因素,并在此基础上提出我国对待平行进口的态度应是在动态中把握利益平衡。
By analyzing the theoretical basis of the exhaustion of rights, it is proposed that the balance of interests is the root of the principle of exhaustion of rights. The balance of interests is the determining factor for each country to consider the parallel imports. Based on this, it is suggested that our attitude toward parallel imports should be dynamic In the grasp of the balance of interests.
